The purpose of the privacy policy of EvSmartec is to explain how we collect and process your personal data through the use of our Website, www.evsmartec.cy, or our Mobile Application (App) Chargaro, and to inform you about your rights in this context.

Chargaro App is managed by EvSmartec, brand and tradename of Smartec Mobility Ltd, established in Cyprus, Reg No. HE 430747, with registered office at 16, Tamassou str, 2411, Nicosia.

We collect and process your personal data to create and manage your user account with EvSmartec or Chargaro (as a user via App or website). The processing is carried out manage your account on the basis of Article 6(1)(b) of the GDPR.

Our privacy policy applies to all personal data EvSmartec processes of everyone who has (had) contact with EvSmartec, such as our visitors, customers and business contacts, in all websites, Apps, or any Social media related to EvSmartec.

What data we collect

The data that is received and stored by EvSmartec and may consist of:

  • Contact information, such as your name, email address and phone number.
  • Account information
  • Billing information such as your credit card information.
  • Charger installation information, including your contact information, car manufacturer and model.
  • Charging Session Information, including date, location, charging point, duration of session, cost and amount of energy consumed.

 Use of personal data

User account management includes: setting up, maintaining and managing, contact identification and servicing, diagnosing and repair of faults on charging equipment, recording and invoicing consumption, arranging payments and assisting with handling refunds, operating and maintaining charging points and safeguarding against misuse.

We will store your personal data for as long as necessary to provide you with the intended services as long as required. Your personal data will be erased or anonymised when it is no longer necessary.

EvSmartec processes data in the performance of its services to the user, the Terms of use are relevant. In some cases, EvSmartec uses an external party for processing personal data. This processor observes at least the same level of personal data security as EvSmartec has laid down in this Privacy Policy. EvSmartec has concluded a processing agreement with this processor in which the same obligations as in this Privacy Policy are laid down.

EvSmartec receives the data described above directly from the user whenever they use the App, create an account and fill in certain details or when a user contacts EvSmartec’s customer service. To ensure optimal use of the App, data relating to the use of the App are also stored. EvSmartec hereby informs all users that this data is handled very carefully.

Using any type of personal data, will at all times be in accordance with the applicable laws and regulations in terms of personal data protection.

Any other personal data to be entered are used for administrative purposes only.

Personal data are entered on a voluntary basis, and this is done for optimal functioning of the App. Users can set their own preferences at various places in the App. For instance, push notifications of offers can be enabled or disabled. These preferences can be changed or turned off at any time.

Storing/sharing of data

 

EvSmartec stores the entered data in the App for offline use. Data are also stored (as a backup) on an external server. Of course, this information is encrypted. The stored data can be viewed in your Chargaro App. If these data are incorrect, you can change them in “settings” “my account” in the App.

The collected data are stored within the European Economic Area (“EEA”). If personal data are nevertheless transferred to or stored at a destination outside the EEA, EvSmartec ensures that this is done in a safe and lawful manner. In that case, EvSmartec will take appropriate measures to ensure that the personal data are protected as much as possible, such as agreeing with the recipients of default data protection clauses drawn up by the European Commission.

Push notifications and/or emails with personal offers are used to inform you as best as possible about the latest news involving the Chargaro app.

EvSmartec does not allow the use of personal data by third parties for commercial, charitable or idealistic purposes.

EvSmartec will only provide your personal data to investigative authorities, government agencies or regulators when required to do so by applicable law or by order of a government authority, and only to the extent necessary to combat fraud or criminal activities.

Your rights

According to the GDPR, you have a number of rights as a customer, including the right of access, rectification, erasure and restriction of processing and the right to object against EvSmartec’s processing of your personal data and to lodge a complaint with the Commissioner for Personal Data Protection.

In addition to the above, you have the following rights which you may exercise by writing to us at [email protected]

  • You may request access to the personal data we process about you
  • You may ask us to rectify or erase your personal data
  • You may object to or ask us to restrict our processing
  • You may ask for your personal data to be provided in a structured, commonly used machine-readable format (data portability)
  • You may at any time withdraw any consent you have given to the processing of your information
  • You have the right to complain to the Commissioner for Personal Data Protection about our collection and use of your personal data or if you feel that we have not addressed your concern in a satisfactory manner you may lodge a complaint with the office of the Commissioner for Personal Data Protection at http://www.dataprotection.gov.cy.

Google maps

When using our App you can also use Google Maps with information on location of charging stations and, while using this service, the App collects data on your location (without however the possibility to use other functionalities as navigation). Our App collects data on your location only on the basis of your separate previous consent and only for the purpose of using this service. Data on your location is stored in your devices’ memory and is not transferred to EvSmartec. Using Google Maps in our mobile apps is subject to the abovementioned Google Maps / Google Earth Additional Terms of Service which are available at: https://www.google.com/intl/pl_US/help/terms_maps/ and abovementioned Google privacy statement, which is available at https://policies.google.com/privacy.

Right to information

A user of the App has the right to receive an understandable and transparent explanation about how EvSmartec handles his personal data and what rights he may exercise in that regard. This Privacy Statement, therefore, explains in detail which data EvSmartec collects from users and how EvSmartec handles these data.

Amendments

EvSmartec reserves the right to amend its privacy policy and advises you to consult this Privacy Statement on a regular basis. In case of any important changes that may affect the processing of personal data, users will be notified in advance.

Compliance with law/Questions

This Private Policy and all practices of Smartec Mobility Ltd are designed to be in compliance with Law 125(I) of 2018 “Providing for the Protection of Natural Persons with regard to the Processing of Personal Data and for the Free Movement of Such Data”, as amended from time to time as well as with the GDPR.
